What Is Mid Range Drink Driving in Queensland?

Mid range drink driving is charged when a driver’s BAC is at or above 0.100 but below 0.150. Governed by section 79(1F) of the TORUM Act, this range is treated more seriously because the level of impairment is presumed to be greater. No evidence of actual impairment is needed — the reading alone establishes the charge.

Immediate Suspension at 0.10+

A BAC at or above 0.10 triggers an automatic immediate suspension of your licence under section 79B of the TORUM Act. You cannot drive until your matter is resolved in court, unless you successfully apply under section 79E to lift the suspension.

Can I Apply for a Work Licence?

Mid range offenders (BAC under 0.15) may apply for a Restricted Work Licence under section 87 of the TORUM Act, provided all eligibility criteria are met — open Queensland licence, no prior drink driving in the past 5 years, and genuine employment dependence on driving. See the Work Licence page for full details.

Yes. Mid range drink driving (BAC 0.10+) triggers mandatory participation in the Queensland Alcohol Ignition Interlock Program. After your disqualification you must hold an 'I' condition licence and have an approved interlock fitted for a minimum of 12 months. Refusing to participate results in a further two-year disqualification.
Potentially yes. The Restricted Work Licence is available for BAC below 0.15. Mid range offenders may apply under section 87 of the TORUM Act provided they meet all eligibility criteria, including no prior drink driving in the past 5 years and genuine dependence on driving for their livelihood. The application must be made at sentencing.
Imprisonment is possible but not automatic for first offences. Courts can impose a fine, community service, or suspended sentence. For repeat offenders the risk increases significantly. Strong preparation — genuine remorse, character references, and traffic offender program participation — reduces the risk.
Gather strong character references, enrol in a traffic offender program, prepare a sincere written plea covering remorse and steps taken, and understand the court process. If applying for a Work Licence, gather employer documentation now — it must be filed at sentencing. The QLD Plea and Work Licence programs guide you through every step.
