Understanding Queensland Drink Driving Penalties

Queensland drink driving penalties are set under sections 79 and 86 of the Transport Operations (Road Use Management) Act 1995 (TORUM). The penalty depends on: your BAC range, whether it is a first or subsequent offence within 5 years, and any aggravating circumstances.

Penalty units: Queensland fines are expressed in penalty units. One penalty unit is currently valued at $148.50 (as of July 2025).

The 5-year window: Repeat offences are assessed based on prior convictions within the preceding 5 years — not prior offences. The date your prior matter was finalised in court is what counts.

Mandatory Minimums Cannot Be Reduced

The minimum disqualification periods below are set by statute. A magistrate cannot reduce them below the minimum, regardless of your circumstances. The court has discretion over where within the permitted range your actual penalty falls — which is why preparation matters.

One penalty unit in Queensland is currently valued at $148.50 as of July 2025. This value is set by the Queensland Government and is periodically adjusted. Fines expressed in penalty units (e.g. ‘14 penalty units’) are converted to dollar amounts using this figure.
Low range (0.05–0.099) first offence: max 14 penalty units (~$2,079) or 3 months jail, 1–9 month disqualification. Mid range (0.10–0.149) first offence: max 20 penalty units (~$2,970) or 6 months, 3–12 month disqualification, mandatory interlock. High range (0.15+) first offence: max 28 penalty units (~$4,158) or 9 months, minimum 6-month disqualification, mandatory interlock.
The 5-year period is measured from the date of your prior conviction — not the date of the prior offence. This means the timing of your current court date can sometimes affect which penalty category applies.
No. Minimum disqualification periods are set by section 86 of the TORUM Act. A magistrate cannot reduce them below the minimum. However, the court has discretion over where within the permitted range your disqualification falls.
Under section 86(5) of the TORUM Act, disqualification periods run cumulatively — each period starts only after the previous one ends. They do not run concurrently.
